  • Cryptocurrency owners – have you made a will?

    Crypto currency is a type of money which is completely virtual, like an on the line version of cash which exists digitally. While some experts argue crypto currency is a risky and volatile investment, it continues to grow in popularity. Crypto currency is one of those odd things which is very private for a lot of people. There are more and more cases of when the family of a person who has died believe they owned Bitcoin but did not have the information to access it following their death. The very nature of the investment means there is often little evidence or information available following a death. This can also happen with online bank accounts.

     

    Making a will with a professional organisation such as a solicitor means that mention can be made at the time of making the will of these otherwise hidden assets. Whilst a solicitor need not necessarily be given access to the assets or passwords, mention can be made of where those passwords can be found, what assets need to be addressed following a death and who has information about them. A professional organisation such as a solicitor has a duty of care and confidentiality to their client so it should be a safe way to ensure privacy but also access following death to assets that might otherwise be lost or forgotten on death.

  • Airlines liable for passengers scalded by spilt coffee, EU court rules

    The Court of Justice of the European Union (CJEU) has ruled that passengers scalded by hot drinks during a flight can hold the airline liable for damages following a case brought by a young girl seeking compensation from now insolvent Austrian airline Niki Luftfahrt when coffee served to her father tipped over during a flight.

    The airline contended that it was not liable since the incident was not covered by the Montreal Convention, which governs compensation for the victims of air disasters, for delays and damage or loss of luggage.

    The airline said it should only be liable for accidents involving hazards associated with flight. It was not clear if the cup tipped due to a defect in the tray or because of the vibration of the aircraft.

    The convention does not define the word “accident”.

    The court said the Montreal Convention’s aim of balancing the interests of airlines and passengers meant damages should not be restricted to flight-related hazards.

    It is now for the Austrian court, where the girl’s case was filed, to use the CJEU ruling to settle the dispute between the airline and the passenger.

  • Relationships: time to move in or out this New Year?

    January is one the busiest months for Family Lawyers: the stresses and strains of the holiday season, with sometimes forced jollity and keeping up appearances, have past and the focus turns to the future.

    The New Year might mean taking the courage to move out of a relationship which is no longer working or perhaps moving an existing relationship into a new phase (moving in together or getting engaged).

    Here are some top tips:
    Get some early advice even if you aren’t yet ready to act on it.
    If possible, tell any children together about your decision to separate/move in with a partner. Encourage them to share any worries with you rather than keep them to themselves.

    If separating; start gathering financial information so you have at least a basic outline of what both parties earn, the capital & savings you have and (in the case of married couples) what pension savings there are.

    If you are planning to move in with a partner, consider a “cohabitation agreement” so you know what your position will be if the new phase of your relationship doesn’t work out as planned.

    Try to focus on planning for a more positive future rather than dwelling on a (perhaps) unhappy recent past.

    Make a Will

    Quite worryingly nearly two thirds of adults in the UK do not have an up-to-date Will. However, by signing an LPA, you can ensure that if this should ever happen, your affairs will be looked after by someone you have personally chosen who you trust.

  • Councils Appeal High Court Ruling On Traveller Ban

    The Court of Appeal has heard a landmark case which could have wide-ranging implications on whether local authorities can use injunctions to place a blanket ban on Travellers camping on public land. 

    London Gypsies and Travellers (LGT) argues that such court orders are discriminatory, disproportionate, and effectively criminalise a centuries-old way of life. Anyone found breaching the injunctions could be fined, imprisoned or have their property seized.

    Bromley Council had applied for a five-year injunction preventing “persons unknown” from camping on open spaces and car parks, but was refused by the High Court in May 2019. It found that the council had not taken account of the rights, needs and welfare of Gypsies and Travellers – especially the best interests of children – nor had it considered alternative, less discriminatory solutions to the shortage of authorised sites.

    On 3 December, Bromley Council appealed the decision with the backing of seven other councils in London and Essex. The outcome of this appeal could have major implications as 37 local councils in England have taken out similar injunctions in the past two years alone.

    Injunction applications, by their very nature, have to be dealt with very swiftly and require specialist knowledge of injunction law and court procedures.
