{"id":7838,"date":"2016-05-20T09:43:26","date_gmt":"2016-05-20T09:43:26","guid":{"rendered":"http:\/\/www.wrigleyclaydon.com\/?p=7838"},"modified":"2017-01-25T16:40:20","modified_gmt":"2017-01-25T16:40:20","slug":"breach-of-contract-solicitors","status":"publish","type":"post","link":"https:\/\/www.wrigleyclaydon.com\/?p=7838","title":{"rendered":"Breach of contract solicitors"},"content":{"rendered":"<p>A QC is facing a bill of hundreds of thousands of pounds after he lost a six-year court battle\u00a0over the purchase of a \u00a33.6 million 30 room 18th century manor.<\/p>\n<p>William Griffiths QC fought against Alan Hardy in a bid to avoid having to pay him for\u00a0pulling out of a deal to buy Laughton Manor in Sussex, which was overhauled by a friend of\u00a0Queen Victoria.<\/p>\n<p>The purchase was cancelled after Mr Griffiths discovered damp, rot and timber decay but a\u00a0court ruled that Mr Griffiths had broken his contract with Mr Hardy and after losing an\u00a0appeal Mr Griffiths must pay Mr Hardy \u00a3385,000 in compensation and costs.<\/p>\n<p>Mr Griffiths withdrew from the deal and refused to pay the \u00a3210,000 owed as part of a 10 percent deposit.<\/p>\n<p>Mr Hardy in turn said he would not refund the \u00a3150,000 which had already paid.<\/p>\n<p>In 2014, the Court ruled that Mr Griffiths had no right to pull out of the deal and ordered him\u00a0to pay \u00a3235,000 damages for breach of contract, in addition to the \u00a3150,000.<\/p>\n<p>In April 2016 the Court of Appeal, sided with Mr Hardy, ruling that Mr Griffiths had no\u00a0prospect of success in overturning the previous High Court decision.<\/p>\n<p>Mr Griffiths claimed that Mr Hardy had misled him about the condition of property during\u00a0the sale.<\/p>\n<p>However, the Court of Appeal accepted Mr Hardy&#8217;s evidence that he had never had the house\u00a0surveyed and was unaware of any damp problem and found that Mr Hardy had an\u00a0&#8216;unconditional right&#8217; to cancel the contract when Mr Griffiths failed to pay the balance of the\u00a0deposit or complete on time.<\/p>\n<h5><span style=\"color: #ff6000;\">If you wish to make a claim for breach of contract, or indeed are facing a breach of contract\u00a0claim then call our breach of contract solicitors on <strong>0161 785 3534<\/strong> and speak to Shalish Mehta in our civil and commercial\u00a0litigation department or email <strong><a style=\"color: #ff6000;\" href=\"mailto:shalish.mehta@wrigleyclaydon.com\">shalish.mehta@wrigleyclaydon.com<\/a><\/strong>.<\/span><\/h5>\n","protected":false},"excerpt":{"rendered":"<p>A QC is facing a bill of hundreds of thousands of pounds after he lost a six-year court battle\u00a0over the purchase of a \u00a33.6 million 30 room 18th century manor.
