    Flexible operating hours pilot scheme for UK courts

    Detailed plans for the flexible operating hours scheme have been published, as the Government continues with plans to change how courts work.

    The pilot scheme, which will be held in 11 courtrooms in England and Wales, is intended to create a system where people work different, but not extended, hours.

    HM Courts and Tribunals Service says it will not expect any individual, to work for more hours in a day than they currently do.

    At Manchester County Court, the proposal is to run an additional half-day either before or after the current court day. Listings will vary over the 12-week period but will start on some days at 8am and finish on others at 8pm. Early sessions are limited to warrant suspensions, civil applications of less than 30 minutes, and adjourned possession work. Later sessions involve small claims, telephone case management hearings and civil applications lasting less than an hour.

  • English same-sex marriages not recognised in France

    France is not recognising same-sex marriages converted from civil partnerships because France does not recognise their English marriages.

    One couple entered a civil partnership in 2008. They converted it to a marriage under the Marriage of Same Sex Couples (Conversion of Civil Partnership) Regulations 2014 which came into force in December 2014. On conversion the marriage is backdated to the date of the couple’s civil partnership.

    The couple now wishes to relocate to France with their adopted son. In France, however, legally-recognised marriages must have had a wedding ceremony with witnesses, and the marriage certificate must reflect the date of the wedding itself.  Consequently, a converted (and backdated) marriage is incompatible with French law and will not be recognised in France. Nor will the adoption of their son be recognised.

    French officials have advised the couple to divorce and re-marry though under English law there are no grounds for divorce.

  • Lufthansa to sign deal to buy parts of Air Berlin

    Lufthansa is set to sign a deal to buy parts of Air Berlin.

    Air Berlin, which is Germany’s second-largest carrier filed for bankruptcy in August after its main shareholder, Etihad, said it would not give further financial support. It reported a record loss of €782m (£713m) for last year.

    Flights continued after a transitional loan of €150m from the German government.

    It has since been negotiating with potential buyers for parts of its business and said last month that negotiations with Lufthansa and EasyJet would continue until Friday.

    Family Justice System

    Ministry of Justice figures highlighting the rising number of private law cases and litigants in person have prompted calls for the government to heed recent warnings about the family justice system.

    13,029 new private law applications, involving over 28,000 children, were made between April and June this year, a 3% increase on the same period last year. Neither the applicant nor respondent were represented in 36% of disposals, compared with 34% in the previous quarter.

    This month the Lord Chief Justice, Lord Thomas told the House of Commons that the rise in private law cases was “deeply worrying”. Suggested solutions included reverting to the old legal aid system or, as is done in California, provide a lawyer in court who can advise on an employed basis.

    Figures show 27,291 divorce petitions were made between April and June, down 10% on the same quarter last year. Resolution said the decline reflected the growing number of cohabiting couples, the fastest growing family type in the UK. “Yet, bizarrely, there is still little or no legal protection for cohabitants should they separate. This needs to change.” Nigel Shepherd, Resolution Chair, said.

    New multi-purpose high technology court complex to open in London

    A multi-purpose high technology court complex will replace all of the City of London’s courts apart from the Old Bailey under plans announced by HM Courts and Tribunals Service.

    The aim is to preserve London’s position as an international dispute resolution centre. The court will specialise in fraud, economic and cyber-crime and will also take on the work of the City of London Magistrates’ Court and City of London County Court.

    The problem of businesses falling victim to rogue debt collection agencies seems to be a continuing problem over the past twenty years with scores of companies being “taken for a ride”.

    The media recently ran stories highlighting the problem of UK’s rogue Debt Collection firms that purport to be professional yet charge their clients for debt recovery services then fail to provide anything at all according to reports. One story told relates to a plumbing company in Surrey who paid over £7300 to Corporate Litigation Services for Debt Recovery services only for little or nothing to be done.

    Despite tougher legislation and regulations surrounding the debt collection industry, criminals are still seeking to gain from wrongful trading tactics.

    The Intellectual Property Act 2017

    The Intellectual Property (Unjustified Threats) Act 2017 came into force last week. It could help intellectual property owners assert rights more freely. The act curtails a legal remedy available to a party threatened with IP infringement.

    From now on parties cannot be held liable for making an ‘unjustified threat’ merely by asserting their ownership. The act also introduces a provision preventing actions from being brought against advisers provided they act on instructions and identify their client in communications.

    Professional advisers, including solicitors, who make a ‘threat’ on a right owner’s behalf will no longer be liable for unjustified threats, provided they make it clear they are acting on the instructions of their client.

    Lord Chief Justice “further court closures are almost certain”

    The Lord Chief Justice has told MPs that further court closures are almost certain as the justice system moves towards a digitised future.

    Lord Thomas said the closures are politically controversial but may be necessary to best deploy resources.

    The Government has almost finished its programme of 86 closures of courts and tribunals throughout England and Wales but speculation remains that numbers may be trimmed further.

    DFS reports a sharp drop in annual profits

    Sofa and living room furniture specialist DFS has reported a sharp drop in annual profits.

    DFS said uncertainty in the economy had led to a “significant deterioration in the consumer market”, and continued weakness of the pound against the dollar had also held back profits.

    Profits dropped 22.3% to £50m although revenues inched up to £762m. DFS has been in business for 48 years. Its brands include Dwell and Sofa Workshop, and it also has brand partnerships with French Connection and House Beautiful. It is in the process of taking over rival brand, Sofology, subject to regulatory approval.

  • Rossdale reveals marriage counselling before Stefani divorce

    Former The Voice coach Gavin Rossdale has revealed that he and singer Gwen Stefani went through “so much counselling” in a bid to save their marriage.

    The couple split in 2013 after 13 years of marriage. Their divorce was finalised in April 2016.

    Gavin and Gwen have three sons together; Kingston, 11, Zuma, nine and Apollo, three.
