    New multi-purpose high technology court complex to open in London

    A multi-purpose high technology court complex will replace all of the City of London’s courts apart from the Old Bailey under plans announced by HM Courts and Tribunals Service.

    The aim is to preserve London’s position as an international dispute resolution centre. The court will specialise in fraud, economic and cyber-crime and will also take on the work of the City of London Magistrates’ Court and City of London County Court.

    The problem of businesses falling victim to rogue debt collection agencies seems to be a continuing problem over the past twenty years with scores of companies being “taken for a ride”.

    The media recently ran stories highlighting the problem of UK’s rogue Debt Collection firms that purport to be professional yet charge their clients for debt recovery services then fail to provide anything at all according to reports. One story told relates to a plumbing company in Surrey who paid over £7300 to Corporate Litigation Services for Debt Recovery services only for little or nothing to be done.

    Despite tougher legislation and regulations surrounding the debt collection industry, criminals are still seeking to gain from wrongful trading tactics.

  • The Intellectual Property Act 2017

    The Intellectual Property Act 2017

    The Intellectual Property (Unjustified Threats) Act 2017 came into force last week. It could help intellectual property owners assert rights more freely. The act curtails a legal remedy available to a party threatened with IP infringement.

    From now on parties cannot be held liable for making an ‘unjustified threat’ merely by asserting their ownership. The act also introduces a provision preventing actions from being brought against advisers provided they act on instructions and identify their client in communications.

    Professional advisers, including solicitors, who make a ‘threat’ on a right owner’s behalf will no longer be liable for unjustified threats, provided they make it clear they are acting on the instructions of their client.

    Lord Chief Justice “further court closures are almost certain”

    The Lord Chief Justice has told MPs that further court closures are almost certain as the justice system moves towards a digitised future.

    Lord Thomas said the closures are politically controversial but may be necessary to best deploy resources.

    The Government has almost finished its programme of 86 closures of courts and tribunals throughout England and Wales but speculation remains that numbers may be trimmed further.

    Are Court video links fit for purpose?

    According to a survey being conducted by former magistrate Penelope Gibbs, director of charity Transform Justice, nearly three-quarters of respondents say video-link hearings in England and Wales have had a negative impact on participation for defendants who do not speak English well or at all, and for unrepresented defendants.

    Sir James Munby, president of the family division, berated the state of equipment in family courts, including his own court in London’s Royal Courts of Justice. Last year a law firm threatened to boycott a pilot virtual court duty scheme, which it claimed was not fit for purpose.

    Boeing and Airbus locked in 13 year dispute

    US aircraft manufacturer Boeing has won a victory in a 13 year-long dispute with European rival Airbus.

    The World Trade Organization has reversed, on appeal, a ruling that Boeing received some state aid to help build its newest aircraft, the 777X.

    However, Airbus said, “the ‘game’ is far from over” as other complaints over alleged aid are still to be resolved.

    The two aviation giants have been locked for years in a set of disputes at the Geneva-based WTO.

    Brussels and Washington have two larger cases pending at the WTO, centered on multiple claims and counter-claims about illegal subsidies for their respective aviation industries.

    Airbus estimates it has lost $100bn in sales because of Boeing subsidies.

    Britain’s longest-running planning dispute resolved

    A planning dispute going back almost 60 years, over a rutted country lane deep in Somerset, has finally been resolved.

    After a battle, believed to be one of the longest in British legal history, the lane outside a cottage once occupied by siblings Archie and Ivy Peppard will be removed as a right of way from the official map.

    The Peppards, who launched the fight in 1959 when they claimed they were besieged by walkers traipsing past their front door, did not live long enough to witness the victory.

    The dispute went all the way to the High Court before a planning inspector agreed that the lane in High Ham was not historically a public right of way.

  • New Balance wins record trademark payout

    New Balance wins record trademark payout

    New Balance has won a record payout in a Chinese trademark case after three local shoemakers were found to have infringed the brand’s “N” logo.

    A Chinese court awarded the US sportswear firm more than 10 million yuan (£1.2m).

    It is believed to be the highest award to a foreign company in a trademark dispute in China.

    The country has been tightening its laws to tackle the widespread problem of trademark abuse.

    Neighbour boundary dispute leaves one with fractured nose and eye socket

    Peter Smythe, a 74 year old pensioner, appeared in court accused of leaving his neighbour Nigel Clark with a fractured nose and eye socket after hitting him with a leaf blower outside their homes during a dispute over a boundary ditch.

    Clark told the court he and his wife, Hervor, were hoping to buy Peter and Gillian Smythe’s house in about 2013/14 but the sale fell through. He then bought Linnel House next door, demolished it and built a new property.

    A landscape gardener had done work to the ditch a few weeks before the confrontation.

    Clark told the court he was unaware of any problem between them. He said that on 4th July he walked past Smythe and said ‘Hello’.

    He told the court, “He said the ditch is half his and I said, ‘It’s not’. I said it’s definitely mine. Very quickly he became quite heated so I said, ‘Calm down.’”

    The trial continues.

    Mortgage possession proceedings on the rise

    New figures released by the Ministry of Justice show that in April to June 2017 mortgage possession proceedings increased by 17% on the same period in 2016 to 5,186.

    This is still considerably short of the peak during the financial crisis from April to June 2009, when claims reached 26,419 over the three-month period.

    Since the pre-action protocol for possession claims based on mortgage arrears came into force, major lenders agreed with the Government not to start mortgage possession proceedings in relation to residential properties unless the borrower had accrued three months’ arrears.
