“boomerang divorce” and “yo-yo couples” on the rise

According to new research from the Co-op, a quarter of divorcees in the UK have considered reconciliation with their ex and 12 per cent actually got back together. Of these, 73 per cent cited managing to forgive an infidelity as the main reason, while 40 per cent simply admitted still loving their ex. This has been called a “boomerang divorce” or “yo-yo couples” – divorcees who get back together with their ex-spouse.

One example is the former footballer Jimmy Greaves who, last week, remarried his ex-wife Irene, 59 years after their first wedding and 40 years after their divorce in 1977.

  • John Lewis profits fall by more than half

John Lewis profits fall by more than half

Profits at the John Lewis Partnership have more than halved after it was hit by re-organisation costs and the impact of the weaker pound following the Brexit vote.

It said profits in the six months to 29 July 2017 fell 53.3% to £26.6m.

John Lewis said the fall in the pound had pushed up its costs, hitting profit margins.

It added political uncertainty had hit customer demand.

John Lewis also suffered a one-off £56.4m charge, mainly for restructuring and redundancy costs.

  • Prenuptial agreements to rise?

It is predicated that there will be a rise in the number of couples seeking prenuptial agreements after the Court of Appeal rejected Karen Hart’s bid for an equal share of her and her ex-husband’s assets.

Karen Hart was awarded £3.5m, out of total resources of just under £9.4m, in a financial remedy order made in June 2015.

Karen Hart’s lawyers said the settlement “should have been based on an equal sharing of the assets they created between them during this time”.

The ruling allows a judge to find that even where it is not properly evidenced, the financial contribution of one spouse outweighs the family and domestic contribution of the other. This can lead to a result that is unfair and discriminatory.

This means that it’s important to establish and prove what assets you have invested into the relationship prior to the official marriage as they could also be included in any payout.

  • Jeans for Genes Day 2017

    Jeans for Genes Day 2017

We’re thrilled to be taking part in Jeans for Genes Day 2017.

On Friday 22nd September Wrigley Claydon staff will shun their usual formal attire in place of everyone’s favourite clothing, a pair of jeans. By pledging a donation for the privilege of dressing-down for a day, our staff will be raising much needed funds for children with genetic disorders.

    Wear jeans, change lives.

Jeans for Genes Day is all about raising money to help some of the most vulnerable children in the UK. Thanks to those taking part the lives of some children with life-altering genetic disorders will be transformed.

1 in 25 children in the UK is affected by a genetic disorder of some kind. Disorders can vary in severity and the limitations they cause. In fact there are over 6000 different genetic disorders.

Money raised through Jeans for Genes Day and other fundraising efforts are used in a variety of ways:

£250 funds a place for a weekend away for children who never meet others with their condition. These life-changing trips build self-esteem and awareness in young people affected by genetic disorders.

£500 pays for a walking frame or other equipment that gives much needed independence to a child whose mobility is limited by their genetic disorder.

£1000 contributes towards a specialist nurse who knows everything about a genetic condition. The nurse helps the child during long hospital stays and families who cope at home.

At Wrigley Claydon we like to support many charities. One way we do this is by promoting charitable giving in Wills via Remember a Charity of with we are members. Our Trusts, Wills and Probate team can offer expert advice about including a charity or good cause in your Will and how this may help alleviate inheritance tax fees. Statistics show most people don’t automatically think about charitable giving in Wills but when it is suggested, most are happy to do so.

To speak to our Wills team about writing a Will or updating an existing one please call 0161 624 6811 or email Rachel Damianou at rld@wrigleyclaydon.com.
  • Britain’s longest-running planning dispute resolved

    Britain’s longest-running planning dispute resolved

A planning dispute going back almost 60 years, over a rutted country lane deep in Somerset, has finally been resolved.

After a battle, believed to be one of the longest in British legal history, the lane outside a cottage once occupied by siblings Archie and Ivy Peppard will be removed as a right of way from the official map.

The Peppards, who launched the fight in 1959 when they claimed they were besieged by walkers traipsing past their front door, did not live long enough to witness the victory.

The dispute went all the way to the High Court before a planning inspector agreed that the lane in High Ham was not historically a public right of way.

  • Redundancies for Asda staff

    Redundancies for Asda staff

Asda is to axe hundreds of jobs at its Leeds head office and a further site in the East Midlands as part of a major cost-cutting drive.

About 300 jobs are to go at Asda House in Leeds and George House in Leicester with job descriptions to a further 800 roles changed.

Figures for 2016, released in September, showed like-for-like sales were down 5.7% compared with the previous year.

Asda is the third-largest UK supermarket behind Tesco and Sainsbury’s but has been hurt by the rise of German discounters Aldi and Lidl.

  • “triple talaq” declared unconstitutional by India’s Supreme Court

An Islamic practice permitting men to instantly divorce their wives has been declared unconstitutional by India’s Supreme Court after decades of campaigning by women’s groups and victims.

The “triple talaq” has allowed Muslim men to dissolve marriages by pronouncing the word “divorce” three times.

The Supreme Court in Delhi took up the issue last year in response to a petition from seven victims and women’s groups. The Court declared this week that triple talaq was “not integral to religious practice and violates constitutional morality”.

  • Employment Tribunal Fees

This week marks almost three months since the abolition of employment tribunal fees. For those who missed it, the ruling followed Unison’s arduous and multi-year appeal against the government’s decision to impose tribunal fees on employees issuing tribunal proceedings. Unison, having had their case rejected at every level, finally succeeded in the Supreme Court. The Supreme Court’s decision, which sent shockwaves through the spine of the legal profession as well as around society, held that the government’s decision to charge fees was unlawful and needed to be abolished. Immediately after the decision, the Employment Tribunal halted receiving payment of fees.

Even to this day, fees have been indefinitely halted. This has affected the ability of claimants to bring claims online (as the IT system underwent ‘maintenance’ for a period).

Under Labour, there had been no fees for issuing a claim but this changed when austerity arrived and the Conservative government introduced fees. The decision is huge and has many ramifications for the Justice system.

Dominic Raab, Minister of State for Courts & Justice, was apologetic for the interference caused to users who had been affected. He maintained that the government was looking at the issue seriously and looking for ways to resolve any funding issues.

The abolition of fees does leave a funding gap for the Justice department. The cost last year of funding employment tribunals was £68,000,000, of which £8,000,000 came from tribunal fees. With all expenditure now under scrutiny, it does beg the question which part of the Justice Department’s budget will be reduced in order to pave way for the increased costs which will be incurred. As lawyers, we’ll leave that to be answered by the politicians.

If, in the meantime, you require any advice on employment matters, call our Employment Tribunal Solicitors, John Porter and Soibi Iketubosin on 0161 624 6811 or email jap@wrigleyclaydon.com or si@wrigleyclaydon.com.
