Legal FAQs

How long will a Probate case take?

Registering the death with various authorities takes about four weeks. Paperwork then needs to be prepared, signed and lodged at the Probate Registry and it will take approximately two weeks to issue a Grant of Probate. Collecting the assets in after Probate has been obtained will hopefully take no more than about four weeks.

It can therefore take about three weeks to complete the Probate Case and maybe more if there is property to sell. Interim payments can always be made to beneficiaries if the case is taking longer than anticipated. Our fees (legal fees) are not paid but are deducted at the end of the case from monies received.
